In the ruling, the US International Trade Commission ruled that all of OMA, MB and GB LED products of Taiwan Jingyuan Company infringed Lumileds' patent rights and decided to issue a limited exclusion order to prohibit wafers and their affiliates, parent companies, subsidiaries, Companies, contractors and other related business units authorized by the wafers import infringing LED chips to the United States, and packaged LEDs containing infringing chips and boards consisting mainly of these packaged LEDs are also within the jurisdiction of the exclusion order. In addition, the Commission instructed that any infringing LED products subject to the import exclusion order during the Presidential Reconsideration shall be subject to a margin equal to the value of the infringing product.
The ruling was an extension of ITC's ruling on February 22, 2007, when the committee partially adopted the preliminary ruling made by the Administrative Judge Harris on January 8 (the preliminary ruling of Lumileds' 718, 580 and 316 patents [United States] Patent Nos. 5087718, 5502316, and 5376580] are valid, and the OMA, MB, and GB LED products of the wafer are not authorized by these patents, and the MB I and MB II products infringe the 718 patent). This time the ruling upheld the interests of Lumileds, and the assertion that all of the controlled products of the wafers that Lumileds insisted on in the investigation infringed on its patent rights were also supported by ITC.
Lumileds expressed great satisfaction with this result and said that it will continue to defend intellectual property and lead the development of global SSL technology.
In addition to the ITC survey, Lumileds and Crystal's lawsuit in the Northern California District Court is still pending. In this case, Lumileds claimed that the OMA, MB and GB LED products infringe their patents and seek compensation and injunctions.
